PRIVACY POLICY

This Privacy Policy, which is also a privacy statement, explains who and to what extent processes personal data within the scope of our website, and within the scope of the activities performed by companies from R.Power Group. At the same time, the Privacy Policy also includes in its scope a description of the applicable principles for processing personal data, including the rights of persons whose data is processed, and generally defines the scope and purpose of the personal data processed. The Privacy Policy applies only to those personal data processing processes that are exclusively undertaken by our organization. Thus, the Privacy Policy does not apply to our business partners, contractors or social media applications, which have their own internal rules for processing personal data. The personal data processed by our organization is processed within the countries of the European Economic Area. If data is transferred outside the EEA, there is no transfer of data that qualifies as personal data.

CONTROLLER

The controller of the website is R.Power S.A. entered in the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register, under KRS number: 0000368949, NIP: 5252492778, initial capital: PLN 8 682 235,75. However, due to a specific legal relationship, the controller of your personal data may be another company within the R.Power Group. This could be, for example, a company with which you have established a business relationship as a contractor, or a company that is your employer. The term controller refers to the definition of controller included in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter “GDPR”).

COLLECTION OF PERSONAL DATA

When using the website, you are under no obligation to provide personal data. However, personal data voluntarily provided by you may be collected and processed through its use. At the same time, within the R.Power Group, when we process personal data, we process it in accordance with the requirements of generally applicable data protection legislation, including the GDPR. As part of our ongoing business activities, we do not process special category of personal data (so-called sensitive data).

PERSONAL DATA WE PROCESS AND THE PURPOSES OF THE PROCESSING

As part of our processing of personal data collected through the website, it is only used for the following purposes:

1. the establishment of cooperation of an economic nature, related to the business purposes of the companies that comprise the R.Power Group. This refers in particular to personal data such as: name, surname, e-mail address, physical address, telephone number, function and position. This range of personal data is processed in connection with contracts concluded between R.Power Group companies and cooperating entities or for the purpose of establishing cooperation / submitting cooperation offers.
2. for employment and recruitment purposes. In this respect the personal data processed may be proceed (but not exclusively) such as those indicated and required by generally applicable laws, including the Polish Labour Code, e.g.: first name, surname, date of birth, contact details, education, professional qualifications, previous employment history.
3. for the purpose of tenancy (Polish: dzierżawa) a plot of land from a potential lessor, who may provide his/her: name, surname, telephone number, e-mail, place of residence, data concerning the real property he/she owns or to which he/she has a legal title.
4. for the purposes of marketing, advertising or educational activities, through media representatives providing their contacts with: name, surname, contact details (telephone number, e-mail address, physical address), position and name of the media company represented.

We process the personal data provided for the purposes indicated above, based on the legal grounds provided for in the GDPR, included in Article 6(1) of the GDPR. Each time, the period of time for which the personal data may be stored is specified, after which it is erased. As part of the personal data provided and entrusted to our organization, we do not use automated decision-making, including profiling. Detailed information related to the processing of personal data within the framework of the specific legal relationship created, where personal data is shared, is included in the specific and shared information clauses.

PRINCIPLES FOR THE PROCESSING OF PERSONAL DATA

R.Power Group processes personal data on the basis of the principles of processing. These are the following principles:

1. legality, fairness and transparency;
2. purpose limitation;
3. data minimisation;
4. accuracy;
5. storage limitation;
6. integrity and confidentiality;
7. accountability.

YOUR RIGHTS

If We process your personal data, you have the following rights:

1. the right to be informed about the personal data we process;
2. the right of access to your personal data;
3. the right to rectification, erasure or restriction of the processing of your personal data to the extent that this is possible and is not prevented by other legislation or the legitimate interest of the controller;
4. the right to object;
5. the right to personal data portability;
6. if personal data are processed on the basis of consent given, the possibility of withdrawing consent at any time without affecting the lawfulness of processing carried out on the basis of consent before its withdrawal;
7. the right of filing a complaint with the competent supervisory authority;

PROCESSING OF PERSONAL DATA

We processing data, including personal data to our business partners, for the proper operation and functioning of the R.Power Group. We processing personal data to:

1. entities supporting us with IT support, maintaining IT infrastructure and providing hosting;
2. entities providing all types of outsourcing services;
3. within the R.Power Group companies, under the condition that it is reasonable and necessary to process such personal data;
4. to our business partners in connection with the fulfilment of our business purposes, in particular data concerning: persons representing our contractors, including data of commercial proxies, members of the management board, persons assisting in the performance of tasks related to our business purposes, tenants, collaborators, employees and any other persons where the transfer of such personal data is necessary and required;
5. authorised collaborators;
6. entities conducting marketing activities on our behalf;
7. entities operating social media;
8. entities authorised under generally applicable law, including entities to which R.Power Group companies are legally obliged to entrust and/or make available the personal data processed.

PERSONAL DATA PROTECTION

In order to guarantee the security of the processed data, including personal data, the Controller applies appropriate technical and organisational measures. For example, the office area is adequately secured, access control has been introduced, and appropriate measures are in place to guarantee IT security.

SOCIAL MEDIA

Our website may use applications connected to social media, through which you can share content with other users of these media. Personal data provided by you in this way are processed not only by our organization, but also by the respective social network. The respective social network processes the personal data provided by you as an entity independent of us, over which we have no control or influence. Accordingly, we will not be liable for any infringement against you due to your data being made available on the respective social network. Generally, if We have an account or fanpage on a particular social network, We have status of  joint-controller over the personal data you provide to our organization. The social networks that may have access to your personal data in connection with the use and tracking of our accounts on these social networks are: Facebook and Linkedin.
